Copyright and DMCA

Programmable LLC respects the intellectual property of others and expects people who use Programmable Apps to do the same. If you believe that something made or shared with Programmable Apps (an app, a shared link, a snapshot or a page on a connected domain) infringes your copyright, you can ask us to remove it as described below. For anything else that looks harmful, use Report a page.

Our designated agent

Send copyright notices and counter-notices to:

  • Programmable LLC, Attn: Copyright Agent
    3607 10th Street Northwest, Washington, DC 20010, USA
    Email: [email protected], with "DMCA notice" in the subject

Email reaches us fastest. This address is only for copyright matters; other messages sent to it under that subject may not get an answer.

What a notice must include

Under 17 U.S.C. 512(c)(3), your notice must be in writing and include:

  • a physical or electronic signature of the copyright owner or of a person authorised to act for them;
  • identification of the copyrighted work you say is infringed or, if several works are covered by one notice, a representative list of them;
  • identification of the material you say is infringing and that should be removed, with enough detail for us to find it, such as the full link (for example a /s/ or /p/ address);
  • your name, postal address, telephone number and email address;
  • a statement that you have a good faith belief that the use complained of is not authorised by the copyright owner, its agent or the law; and
  • a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act for them.

A notice that leaves out these things may not be acted on. Before you send one, consider whether the use could be a fair use. Under 17 U.S.C. 512(f), anyone who knowingly makes a material misrepresentation in a notice or a counter-notice may be liable for damages.

What we do with a notice

When we receive a notice that meets these requirements, we act quickly to remove or disable access to the material, for example by pausing the link or the snapshot. We tell the person who made it that we have done so and send them a copy of the notice, which may include your name and contact details.

Counter-notice

If material you made was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to the agent above. Under 17 U.S.C. 512(g)(3) it must include:

  • your physical or electronic signature;
  • identification of the material that was removed or disabled, and where it appeared before it was removed (its link);
  • a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material;
  • your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Programmable LLC may be found), and that you will accept service of process from the person who sent the notice, or their agent.

When we receive a valid counter-notice, we send a copy to the person who sent the original notice and tell them that we will restore the material in 10 business days. We restore it no sooner than 10 and no later than 14 business days after we receive the counter-notice, unless that person first tells us they have filed a court action to stop the infringement.

Repeat infringers

We close, in appropriate circumstances, the Programmable Apps access of anyone who repeatedly infringes copyright. We count notices that we acted on and that were not answered by a valid counter-notice. We may also pause a person's links, or remove material, sooner where the infringement is clear. This is part of our Terms of Service.
